General Conditions of Service

These General Conditions of Service “GCS” contain the complete expression of the agreements in force between Servicios y Gestión Izabra and the Client/s, and replaces and cancels any other contract or previous agreement between them in relation to its object.

SERVICES AND CONCLUSION OF CONTRACTS.

These General Conditions of service regulate the supply to the client/s of the services offered by Izabra Services and Management (hereinafter “Izabra”), with registered office in London, United Kindong (UK), with Customer Service telephone number to the Client (44) 20 4577 2706. The agreements between Izabra and the Client in relation to the individual Services will be considered concluded as soon as Izabra receives the payment of the fees for them.

NATURE OF SERVICES – FEES AND PAYMENTS.

Izabra will not carry out any operation in relation to a requested service until payment has been received in accordance with the conditions and within the term. Izabra will consider the payment made once the bank makes it effective. The payment of the order will be made in accordance with the general payment conditions established by Izabra. Once the processing of any order has begun, Izabra reserves the full right to apply a cancellation penalty. Izabra will automatically cancel orders that are not paid within 3 to 5 calendar days. The applicant exempts Izabra from any liability to third parties caused by non-compliance with the obligations derived from any of the conditions. Izabra has adopted the technical and organizational measures, as well as the level of security required by law in accordance with the provisions of Organic Law on the protection of personal data (DPOL), as well as the regulations that develop it. The applicant certifies that the information provided and related to data collection, as well as the personal information of the contacts of the client name, is true and complete. Similarly, the applicant agrees that he is solely responsible for keeping the information up to date. The notifications will be made according to the data provided by the applicant by a means that proves their presentation, preferably electronic communication. Izabra will not be responsible for the non-receipt of these notifications. The applicant is responsible for informing Izabra of any changes in the data, especially changes in contact email addresses. Failure to comply with any of the conditions accepted by the applicant will authorize Izabra to cancel any order, giving it full power to apply the stipulated penalty.

Failure to pay part or all of the service freely contracted by the client will entitle Izabra to cancel said service and establish the conditions required for its resumption.

In cases of cancellation of services in labor or tax procedures, Izabra will not make any presentation before the corresponding administrations for non-compliance with the established payments, likewise any requirement or sanction by the administration or competent body, will be the sole responsibility of the client and Izabra Management disclaims all liability.

Any request made by the administrations or competent bodies that affect the canceled period/s, Izabra Management will reject the attention to said request, being the sole responsible for allegations the client himself.

In relation to the other services marketed by Izabra, the cancellation of the service due to non-compliance with the contractual conditions, will empower Izabra to terminate and eliminate the service affected by the non-compliance, without affecting the others contracted by the client, for the services of web design, graphic design, web maintenance, domains, hosting, web servers, access may be blocked until payment is regularized by the client, at the same time, the client will lose the rights to use or exploit the material or content affected by the breach.

PAYMENT METHODS.

Payment methods established by Izabra.

– Credit card

Payment must be made within the term and in accordance with the conditions chosen by the Client, and will be made in euros. Izabra reserves the right to cancel a registration if the payment has been made by fraudulent means or has not been made. Orders that have not been paid within 3 to 7 calendar days will be automatically canceled without prior notification.

USE OF THE SERVICES AND CUSTOMER RESPONSIBILITY.

The Client undertakes to act loyally and in good faith during the exercise of the contracted services. In the same way, the Client undertakes to do everything possible to comply with the provisions and commitments in accordance with these general conditions and the conditions of the services, as well as to respect, in the case of the services offered by Izabra in a shared manner, the quality, stability and security of the services even with respect to the use of other Clients.

LIMITS OF IZABRA’S LIABILITY.

Izabra undertakes to act diligently and in good faith in its commercial relations with the client. Likewise, it undertakes to offer the best quality at all times when providing its service, except for those external incidents beyond its control.

Izabra cannot guarantee that the order requested by the client will be feasible.

Izabra does not assume responsibility for possible errors caused by other participating organizations throughout the process of providing the service.

APPLICABLE LAW AND JURISDICTION.

The applicable laws regarding this contract, its interpretation and resolution will be UK. The Courts of London will have exclusive jurisdiction in any dispute involving this Agreement or its performance, or arising from them. Regarding any divergence derived from this contract, any of the parties has the possibility of opting for any legal arbitration channel,  as well as submitting it to the corresponding civil jurisdiction. In the event that an arbitration or judicial procedure is initiated, according to the law, the clauses of this contract will continue to have effect and will be respected by both parties.
